Terms and Conditions

Welcome to Soléia House. These Terms and Conditions govern your use of our website at soleiahouse.com and all purchases and dress rentals made through it. Please read them carefully before placing an order or booking a rental.

1. Introduction and Acceptance

By browsing our website, placing a purchase order, or booking a rental, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

Your electronic acceptance of these Terms — by clicking “Place Order,” “Confirm Booking,” or any similar button — constitutes a valid and binding agreement under the Electronic Commerce Act of 2000 (RA 8792). Electronic contracts formed in this manner carry the same legal weight as written contracts signed in person.

These Terms apply to both purchases (outright sale) and rentals (temporary use of garments owned by Soléia House). Rental-specific conditions are set out in Section 9.

2. Business Disclosures

  • Legal Name: La Mode Saoirse
  • Trade Name: Soléia House
  • DTI Business Name Registration No.: [TO BE PROVIDED: DTI Business Name Registration number]
  • Registered Business Address: [TO BE PROVIDED: registered business / physical address]
  • Email: supportsoleiahouse@gmail.com
  • WhatsApp / Phone: +63 945 329 0183
  • DTI E-Commerce Trustmark No.: [TO BE PROVIDED: DTI E-Commerce Trustmark registration number]

3. Product Descriptions and Accuracy

We make every effort to display our garments accurately — including photography, colour descriptions, fabric details, and measurements. However, please note:

  • Colours may appear slightly different depending on your screen’s calibration. This is not considered a defect.
  • Measurements provided are approximate and may vary slightly by item. We encourage you to review size guides and reach out before ordering if you are between sizes.
  • For rental items, photographs reflect the current condition of the garment. Minor, disclosed pre-existing wear is not a defect.

If a product is materially different from its description upon delivery, your consumer rights under RA 7394 and Section 8 of these Terms apply in full.

4. Pricing and Payment

All prices on soleiahouse.com are displayed in Philippine Pesos (₱) and are the final prices you pay unless otherwise stated. We do not operate a “PM for price” model — all prices are clearly listed on each product page.

  • VAT status: [TO BE PROVIDED: VAT-registered or Non-VAT registered]
  • Payments are processed securely by PayMongo Philippines Inc. We accept:
    • GCash
    • Maya
    • Credit and debit cards (Visa, Mastercard)
    • BPI Online Banking
    • Bank transfer
  • We do not store your card number, CVV, or full bank account details. These are handled entirely by PayMongo, which is PCI-DSS certified.
  • Payment must be completed in full before any item — whether a purchase or a rental — is dispatched or released.

5. Purchase Orders and Processing

Once you complete checkout and receive a confirmation email from Soléia House, a binding contract of sale has been formed between you and La Mode Saoirse under RA 8792. That email is your order confirmation.

We reserve the right to cancel an accepted order in the following limited circumstances:

  • The item is no longer available due to a stock error
  • A pricing error was published on the website
  • We have reasonable grounds to suspect fraudulent activity

In any such case, you will be notified immediately and will receive a full refund to your original payment method. We will never cancel a legitimate, in-stock order for any other reason.

6. Shipping and Delivery

We ship to addresses within the Philippines only. Full details of our shipping rates, timeframes, and courier partners are available in our Shipping Policy.

Key points:

  • We ship via J&T Express, LBC Express, and Lalamove. The courier assigned to your order may vary depending on your location and availability.
  • Estimated delivery times are provided as guidance and are not guaranteed. Actual delivery may be affected by courier capacity, weather, public holidays, or other factors outside our control.
  • You will receive a tracking number via email or SMS once your order has been dispatched.
  • Free shipping applies when you purchase two (2) or more items in a single order within the Philippines.
  • We are not liable for delays caused by the courier, force majeure events, or an incorrect delivery address provided by the customer. If a parcel is returned to us due to an incorrect or incomplete address, you may be charged re-delivery fees.

7. Returns, Exchanges, and Refunds for Purchases

Your consumer rights are protected under the Consumer Act of the Philippines (RA 7394). A “No Return, No Exchange” policy is prohibited under Philippine law and is not enforced by Soléia House.

Full details are in our Returns and Exchanges Policy. The key points are:

  • You may return a purchased item within 7 days of delivery if it is defective, damaged upon arrival, the wrong item, or materially different from its description.
  • Your remedies are: repair, replacement, or full refund — at your choice.
  • We will shoulder the return shipping cost for defective or incorrect items.
  • Refunds are processed within 1–7 business days to your original payment method.

8. Warranties

Under RA 7394 (Consumer Act of the Philippines), all goods sold carry an implied warranty of merchantability — meaning the item is fit for its ordinary purpose and is of acceptable quality. This implied warranty is valid for one (1) year from the date of purchase.

This warranty does not cover:

  • Damage caused by misuse, neglect, or alterations by the customer
  • Normal wear and tear after delivery
  • Items damaged due to improper washing or care contrary to garment instructions

Nothing in these Terms limits or excludes any statutory warranty rights you have under RA 7394 or RA 11967.

9. Rental Terms

This section governs all dress rental transactions. A rental is a contract of lease under the Civil Code of the Philippines (Articles 1642–1688). At all times, the garment remains the exclusive property of La Mode Saoirse / Soléia House.

9.1 Rental Period

Soléia House offers a 3-day rental period for nearby areas (dispatched via Lalamove) and a 7-day rental period for nationwide deliveries (via J&T Express or LBC Express). The rental price is the same regardless of the period. The rental period begins on the date the dress is delivered, or the agreed delivery date shown at checkout. The return date will be confirmed in writing at the time of booking.

9.2 Reservation Fee

A non-refundable reservation fee of [TO BE PROVIDED: reservation fee amount, e.g. ₱X] is required to secure your booking. This fee is applied toward your total rental payment but is not refunded in the event of cancellation.

9.3 Full Payment Before Release

The remaining balance of the rental fee must be paid in full before the garment is released or dispatched. We accept the payment methods listed in Section 4.

9.4 Security Deposit

A refundable security deposit of ₱1,500 per dress is required for all rental transactions. The deposit is collected at the time of payment and:

  • Will be returned to you in full after inspection of the returned garment, provided the item is returned on time and in its original condition.
  • Will be used, in part or in full, to cover late return fees, cleaning costs, repair costs, or replacement value where applicable.
  • Refund of the deposit will be processed within 1–7 business days of confirmed return receipt.

9.5 Condition at Pick-Up and 24-Hour Inspection Window

Please inspect the garment carefully upon receipt. You have a 24-hour window from the time of pick-up or delivery to report any pre-existing damage or discrepancy not noted in the item listing, by sending photos and a written description to supportsoleiahouse@gmail.com or via WhatsApp (+63 945 329 0183). Damage reported after this window is considered to have occurred during your rental period.

9.6 Care of the Garment

  • Handle the garment with care, as you would your own.
  • No permanent alterations are permitted — no cutting, sewing, dyeing, or any other irreversible modification.
  • Professional cleaning is included in the rental fee. Customers must not wash, dry clean, iron, bleach, or otherwise attempt to clean the dress. Soléia House handles all professional cleaning.

9.7 Late Return Fees

Items returned after the agreed return date will incur a late fee of ₱250 per calendar day after the scheduled return date. Late fees will be deducted from your security deposit. If the accumulated late fees exceed your deposit, the outstanding amount becomes immediately payable.

9.8 Damage, Loss, and Staining

You are responsible for the garment during the rental period. If the item is returned damaged, stained, or lost:

  • We will assess the damage in writing and share that assessment with you.
  • Repair costs and professional cleaning costs will be deducted from your security deposit.
  • For lost items or total damage, the customer will be charged the full retail purchase price of the dress, plus any outstanding late return fees.
  • If costs exceed the deposit, you will be invoiced for the difference, which is payable within 7 days.
  • If the dress is not returned within 7 days after the scheduled return date and there has been no prior communication, the dress will be considered lost and the customer will be charged the full replacement value of the dress.
  • Minor, pre-existing wear that was disclosed at the time of rental is excluded from damage charges.

9.9 Cancellation and Forfeiture

  • Cancellations made 7 or more days before the rental start date receive a full refund of both the rental fee and the security deposit.
  • Cancellations made less than 7 days before the rental start date: the rental fee is non-refundable, but the security deposit is refunded in full.
  • No-shows (failure to collect without prior notice): the full rental fee is forfeited and the security deposit is returned within [TO BE PROVIDED: X] business days.

9.10 Valid Government ID Required

A valid Philippine government-issued photo ID must be presented and copied before any rental item is released. Accepted IDs include: PhilSys National ID, Passport, Driver’s License, SSS ID, UMID, PRC ID, and Voter’s ID. The ID copy is handled in accordance with our Privacy Policy.

9.11 Liability Limits for Rental

Our liability to you for any rental claim is limited to the amount of the rental fee paid, except where such limitation is prohibited by law. Nothing in this section limits your statutory rights as a consumer under RA 7394 or RA 11967.

9.12 Force Majeure

Neither party is liable for failure or delay in performance caused by circumstances beyond reasonable control, including natural disasters, typhoons, government lockdowns, or transportation stoppages. Where force majeure prevents a rental from proceeding, we will work with you in good faith to reschedule or issue a credit.

9.13 Rental Exchanges

Exchanges are allowed before dispatch at no additional charge, subject to the requested dress being available. Once an item has been dispatched, exchanges are not permitted.

9.14 Return Logistics

Customers are responsible for arranging and paying for the return shipment. Customers in nearby areas may return via Lalamove at their own expense.

However, nothing in these Terms limits or excludes any rights you have under RA 7394 (Consumer Act), RA 11967 (Internet Transactions Act), or other mandatory Philippine consumer protection legislation. Those statutory rights always apply.
